Mason &Carter's Restitution Law in Australia 5th Edition (2025)

Sutton on Insurance Law 5th Ed (2025) 2 Volumes

The new edition of Sutton builds on the authority and reputation of earlier editions while covering Australian developments in legislation, regulation and case law since the last edition was published in 2014. As with previous editions, the text contains discussion of the most important English and Australian cases, thereby emphasising that the Insurance Contracts Act 1984 (Cth) is far from a comprehensive code and that many issues of principle as well as of interpretation remain firmly within the province of the common law.

International Arbitration in Australia (2010)

This is the first book to present a comprehensive picture of international commercial arbitration (ICA) and investor-state arbitration (ISA) from an Australian perspective. Australian experts in international arbitration have played important roles in transforming ICA world-wide since the 1950s into the preferred means of resolving commercial disputes, and some are now helping to lead the way in the burgeoning new field of ISA.

For the Sovereignty of the People (1999)

This is a book on politics, history and legal philosophy like no other. Featuring an introduction by the late Sir Walter Campbell AC QC, former Governor and Chief Justice of Queensland, it argues that the republican ideal of government ...of the people, by the people, for the people has permanently parted company from the republican form of government. A monarchist, not a royalist, the author argues that the important aspects of the monarchy are not the sentimental or tabloid details, but the constitutional role that has evolved within parliamentary democracy over centuries, in Britain and the rest of the Commonwealth. The book advocates the importance of the Crown in the Westminster parliamentary system of democracy, to limit executive power and help preserve peaceful, culturally diverse societies in Australia, the United Kingdom, Canada and New Zealand. Contrasts are presented between the legal safeguards inherent in the Westminster system with the failures of governance in the United States and France.

Ministerial Advisers in Australia - The Modern Legal Context (2016)

From their origins in the shadows of Australian public administration, ministerial advisers have been increasingly thrust into the limelight through scandals that appear on the front page of the newspapers. This book traces the rise in the power and significance of Australian ministerial advisers. It shows the fundamental shift of the locus of power from the neutral public service to highly political and partisan ministerial advisers. The book demonstrates that the introduction of ministerial advisers into the structure of the Executive has led to the erosion of the Australian system of responsible government. This is caused by a failure in the political, legal and managerial accountability frameworks surrounding ministerial advisers. Ministerial Advisers in Australia is the first comprehensive study of the legal and political regulation of Australian ministerial advisers. This book features material from original interviews with Australian Ministers and Members of Parliament, as well as several former State Premiers.

Policing Vulnerability (2012)

In a constantly evolving context of performance management, accountability and risk assessment, police organisations and frontline police officers are required to pay careful attention to what has come to be known as ‘at risk people’, ‘vulnerable populations’ or ‘vulnerable people’. Vulnerable people have become a key focus of policy. Concurrently, there have been stronger demands on police, and a steep increase in police powers in relation to their interaction with vulnerable people. The premise of this protectionist and interventionist agenda is threefold: to protect the rights of vulnerable individuals proactively cater for their vulnerability within the justice system; and to secure police operations and protocols within strict guidelines. This collection unpacks ‘vulnerable people policing’ in theory and practice and guides the reader through the policing process as it is experienced by police officers, victims, offenders, witnesses and justice stakeholders. Each chapter features a single step of the policing process: from police recruit education through to custody, and the final transfer of vulnerable people to courts and sentencing.

Western Legal Traditions -A Comparison of Civil Law & Common Law

The rule of law constitutes the hallmark of contemporary Western society. However, public perceptions and attitudes to the law can vary in space and time. This book explores legal solutions to selected problem scenarios in their broader historical, economic, political and societal context. The focus is on the legal traditions of civil law and common law. The book is premised on the assumption – indeed, the conviction – that use of the comparative method both facilitates and promotes a deeper understanding of the society in which we live and the rules by which it is shaped. Major ‘threads’ that run through the book are the relationship between law and morality, the role of the state in regulating human interaction, as well as the relationship between the state and the individual.

Calling Out The Troops- The Australian Military and Civil Unrest

A recognised expert on military call-out law, Associate Professor Michael Head, examines the troop call-out legislation introduced in 2000 and 2006, and reviews the ongoing Constitutional and legal uncertainties. This book raises a number of crucial issues that have received little public attention. The Australian Defence Force can be deployed on such vague grounds as ‘domestic violence’ and ‘Commonwealth interests’. Military commanders are given sweeping powers, including to use lethal force, shoot down civilian aircraft, interrogate people, raid premises and seize documents.

Policing the Rural Crisis (2006)

This book brings a fresh approach to the study of crime that challenges the urban-centric assumptions of much western criminology and sociology. It explores rural crime and social reactions to it, in relation to processes and patterns of community formation and change in rural Australia, including the social, economic, cultural and political forces shaping the history, structure and everyday life of rural communities. Policing the Rural Crisis is based on five years of extensive original empirical research in rural and regional Australia. It draws on ideas and debates in contemporary social theory across several disciplines, making the analysis relevant to the study of crime and social change elsewhere.

From Protection to Competition (2015)

Economists have explored the effect of restrictive practices on markets, and legal scholars have examined the legislation, policies and institutions in specific cases. This work takes a historical approach and examines the occurrence of cartels and other restrictive practices in Australia, their resilience, and the attempts to constrain them. Fixing prices and rigging markets began with the First Fleet. Many practices were imported but home-grown firms embraced the anti-competitive culture. The small market size and population encouraged firms to stabilise their working environment. Colonial government legislation against these anti-competitive practices largely failed. The first anti-trust legislation, passed in 1906, proved useless. Despite evidence of restrictive business practices, four Constitutional referendums to give the Federal government power to control trusts and monopolies failed, as did legislation in individual states.

Pillars of Power (2007)

Pillars of Power examines Australia's most important political, legal, and social institutions--the government, the courts, the unions, the media, the economic regulators, the defence and security apparatus, the universities, even sport. David Solomon looks at how these institutions have changed in the modern era and how they operate today--their influence, their strengths and their weaknesses. His book is based on extensive interviews with the people who have driven the change, most notably in the phenomenal growth in prime ministerial power and the downgrading of Parliament.

Sir Valentine Fleming - Second Chief Justice of Tasmania

This biography, the 12th in Bennett’s Lives of Australian Chief Justices, commemorates the distinguished career of Tasmania’s Sir Valentine Fleming. An English barrister of Irish descent and education, Fleming arrived in Hobart as Insolvency Commissioner. A “useful man” to government, he advanced as Crown Law Officer and served ex officio in the Legislative Council until succeeding Sir John Pedder as Chief Justice in 1854. This elevation released Fleming from a political role he hated and enabled him to dispel the enmity his pro-government views in that role had attracted.

Sir John Pedder - First Chief Justice of Tasmania

John Pedder, a shy, ascetic, “gentlemanly” personality, was appointed first Chief Justice of Tasmania in 1823. Even he was surprised; he had been only three years in practice. Probably, his loyalty to the Church of England appealed to the Colonial Office. The new Chief Justice was shocked by the cost of living in the convict colony of Van Diemen’s Land, the reduced state of society, and the harshness of the dominant penal system. He was acutely conscious of the finality of the death penalty and publicly protested the ill-treatment of Tasmanian Aborigines. In his very first trial, the first held in any Australian Supreme Court, a white man was convicted of the manslaughter of an Aboriginal.

Sir Charles Cooper - First Chief Justice of South Australia

Charles Cooper, a timid, retiring, weak-voiced, sickly and barely successful English barrister, accepted appointment as Judge in South Australia in 1839. A sound rather than a brilliant lawyer, duty was his watchword, evangelical churchmanship his consolation. For 17 years, he trudged on through illness and the meanness of the Colonial Office which saw him one of the worst paid judges on colonial service. In 1856 he was recognized at last with appointment as the Province’s first Chief Justice. Dr Bennett shows that the appointment was well merited. In a strong re-evaluation, Cooper is shown to have been a good and effective judge, whose puny modern reputation has been shaped too much by the distorted, politically based, views of critics of his day. His early years on the Bench required him to grapple with the problem of trying to apply English law to the indigenous people. He brought peace to a querulous legal profession and did much to reverse entrenched community contempt for authority existing in Adelaide on his arrival.

A History of Australian Legal Education

A History of Australian Legal Education examines the history and development of legal education in Australia by tracing the establishment of university law schools and other forms of legal education in the States and Territories from the time of European settlement in 1788 to the present day. While early Australian legal education was founded on historic practices adopted in England and Wales over many centuries, the circumstances of the Australian colonies, and later States, have led to a unique historical trajectory. The book considers the critical role played by legal education in shaping the culture of law and thus determining how well the legal system operates in practice.

Creighton & Stewart's Labour Law 6th Ed (2016)

The latest edition of this leading text features a new and expanded team of authors, who explain and analyse Australia’s complex system of labour regulation. The book has been substantially restructured and updated to cover the many statutory amendments introduced or proposed over the past five years, especially to the Fair Work legislation, but also on matters such as work health and safety. A particular feature is the coverage of the Productivity Commission’s 2015 report on the workplace relations system, outlining both its assessment of the regulatory framework and recommendations for change. There is discussion too of other important inquiries and reviews, including the Fair Work Commission’s changes to the modern award system and the Heydon Royal Commission into Trade Union Governance and Corruption. The new edition also outlines the policy proposals released during the 2016 election campaign and explores the potential for future reforms.

Biometrics, Medicine and The Criminal Law (3 Volumes) 2012/2013

To date, little analysis exists of the criminal process's roles as a regulator of medical practice and as an arbiter of bioethics, nor whether criminal law is an appropriate forum for judging ethical medical dilemmas. The conscription of criminal law into moral controversy and the (perceived) rise in criminal investigations of medical errors sets the backdrop for this innovative historical and theoretical analysis of the relationship between medicine, bioethics and the criminal process. Case studies on abortion, end of life and the separation of conjoined twins reveal how judges grapple with bioethics in criminal cases and the impact of 'theatre' on the criminal law's response to ethically controversial medical cases. A central argument is that bioethics and criminal law are not necessarily incompatible; rather, it is the theatre surrounding interactions between bioethics and criminal law that often distorts and creates tension.

Practical Guide to Litigation (1998)

Against the background of Lord Woolf's interim report "Access to Justice", this text includes accounts of tactical matters and practical litigation "tips", as well as descriptions of the procedures involved. Litigation is often conducted by companies who do not have much practical experience of the processes that might be expected of them. The same applies to others who become involved in litigation without actually having to conduct the procudure as lawyers. Hearsay Evidence in Criminal Proceedings 2nd Edition (2014)

Since the appearance of the first edition, the new law on hearsay evidence has been the subject of a spectacular exchange between the UK Supreme Court and the European Court of Human Rights, the effects of which the Court of Appeal has interpreted in several leading cases. In this new edition, the commentary is revised to take account of these developments. As in the first edition, the commentary is preceded by chapters on the history of the hearsay rule, and the requirements of Article 6(3)(d) of the European Convention on Human Rights. It is followed by an appendix containing the text of the statutory provisions and a selection of the leading cases.

Military Law in Colonial Australia

This book breaks new ground in reviewing the naval and military law of the Australian colonies before their federation in 1901. Its particular focus is on the disciplinary codes contained in Acts of Parliament and subordinate legislation. A disciplinary code takes a certain form having regard to the nature of the force to which it is to apply, which in turn depends on the circumstances in which the force is raised and its proposed role.

Power At Work- Rebuilding the Australian Union Movement

For the past 100 years, Australian unions have played a key role in protecting and improving the wages and working conditions of Australian employees. Now, membership is collapsing and the union movement is under unprecedented political attack. How can it rebuild itself so as to play its role in the modern deregulated, globalised world? In Power at Work, Michael Crosby documents the crisis facing the union movement and focusses on the central role of organising workplaces and industries in an evidence-based plan for renewal. He proposes an agenda which is hardheaded, practical and achievable, one based on the recent experiences of successful unions – unions where the membership numbers are going up.

The Tasmanian Dam Case 30 years on

In one of the great contests between State and federal power, the Tasmanian Dam Case pitted the immovable object of Tasmania’s commitment to a massive hydro-electric project against the irresistible force of the Commonwealth’s determination to protect the environment. Who would prevail? Was it more important to create jobs and provide cheap power, or to preserve the natural beauty of the Tasmanian wilderness? On whom did the Australian Constitution confer the power to decide this question? By the narrowest of majorities, the High Court decided in 1983 that the Commonwealth had the final say, and upheld legislation that prohibited the construction of a dam on the Gordon River below the Franklin.

Tribunals in the Common Law World (2008)

Tribunals are a flexible method of adjudication that hear disputes between citizens and by citizens against government. They come in diverse forms, and their adjudications far outnumber those of courts. For most people, tribunals are the face of justice. Increasing attention is being paid to tribunal procedures, what decisions they can make, and who are appointed as tribunal members. This book provides a contemporary snapshot of tribunals and tribunal jurisprudence in the common law world, with contributions and comparative studies from Australia, Canada, New Zealand and the United Kingdom.

Juries in the 21st Century (2012)

This book provides a broad understanding of and critical thinking about the contemporary jury system. It fills a void of easily accessible knowledge about how jury trials work and how jury research assists us to formulate new ways to improve the system. Current issues challenging the jury system, such as the impact that technology is having on jury trials, are discussed. Juries in the 21st Century is designed to inform jury practitioners (judges, barristers, instructing solicitors, and forensic experts) about what constitutes best practice for them. It details how other jurisdictions are dealing with issues within their jury systems and allows jury practitioners to understand which practices are based upon fact and which are based on habit, anecdote and other misconceptions.
